Prosecutor Mark Pafford told The Bakersfield Californian that the district attorney's office does not believe there's a reasonable likelihood that a jury would find Porter guilty beyond a reasonable doubt.

"Based upon the information that was provided to us by the CHP, we did not believe that there would be a reasonable likelihood that a jury would find Mr. Porter guilty beyond a reasonable doubt of the allegations. With this belief, we thought it was not appropriate for us to proceed," Supervising Deputy District Attorney Mark Pafford said.
Porter, 33, was arrested by the California Highway Patrol early Saturday in a fast-food restaurant parking lot in Bakersfield.
According to the CHP, Porter refused to provide his driver's license and began to raise his window when asked to leave the car. Police say that when an officer reached to unlock the door, Porter slapped the officer's hand.
Porter had alleged he was struck by the officer who arrested him Saturday, the Bakersfield Californian reported Wednesday.
The 11-year veteran recently signed with the Cardinals. He also has played for Pittsburgh and Miami.
